A. Obviously if you allow the DA to lapse you will have to apply for a new one which you may find it difficult to obtain. Irrespective you will need to prove to the local council that substantial works have commenced on the site and provided you have enough time you should carry out substantial earthworks which may assist you in this regard.

Q. What does home warranty insurance cover?

A. Formerly it used to cover both defects and the death, disappearance and insolvency of the builder, however today defects remain to be addressed directly by the builder with the latter three categories the subject of insurance.

Q. I have designed and constructed a number of houses over many years and I am concerned as to whether I could be pursued by a building warranty insurer where they have settled with the claimant and my involvement has been zero?

With most building contracts there is a retention which can be held back pending satisfactory completion of the works mainly to cover defects.

Q. Should a home warranty certificate be sighted before the builder commences work on site?

A. Yes. Although building warranty insurance is of limited value as it now no longer covers defects it is extremely important where builders or building companies go to the wall which occurs with greater frequency in times of an economic downturn.

Q. What should I do where I am physically threatened by the builder and I am dissatisfied with the progress and quality of the works performed?

A. First you should report it to the police. Second – retain a lawyer and obtain independent legal advice. Third – if you are in arrears bring the arrears up to date. Fourth – refuse to pay where the builder is clearly in breach of contract. Five – check all variations to ensure that they are properly claimed and are within time.

Q. How effective is disputes resolution when dealing with Australian construction and infrastructure projects?

A. Parties in dispute are often dissatisfied with the disputes resolution procedures in contracts. Unfortunately disputes are widespread throughout Australia and are normally associated with cost overruns irrespective as to how or why they arise. Essentially the majority of parties are not satisfied with the time, cost, process and outcome of disputes resolution. A lot of this can be traced back to insufficient time being applied to disputes resolution clauses at the time of precontractual negotiations. As in all these cases very little time is spent on precontractual matters with some contractors preferring to issue documentation themselves without referring it for proper legal advice to avoid these issues. The fees charged in this area are not a cost but investment in the future and it gets back to the age old adage of being penny wise but pound foolish. Who can afford the increased costs of unsatisfactory disputes resolution or litigation when the real money should have been spent up front obtaining proper legal advice and assistance rather than throwing buckets of money at a process which will surely leave one party badly disadvantaged and potentially wearing substantial costs.

• Electricians don’t like dust and having to chase cables into walls, they would much rather run the cables along the top of the skirting or straight up the walls in a nice little white plastic box;
• Electricians study more than anyone else in building & construction. Because of that they cant’ work long hours on site like other tradesmen. Mostly they like to study birds, horse racing, and football. They can be found studying most days in cafes, pubs and bookies;
• Electricians charge far more than other tradesmen – presumably to pay for the extensive studies.

How To Deal With Electricians In Your Home

First off you have to remember that electricians are not like other tradesmen and won’t wake you up too early in the morning. Don’t expect them until at least 10am.

Now you need to remember that if you need any little job done you have to move everything out of their way or preferably clear out the room if you need a replacement socket or switch.

Electricians don’t like working in rooms with furniture and I think it’s against their religion to move furniture or lift anything too heavy so you need to remember this if you want to get the job done.

Dust sheets can be a problem because electricians are mostly oversized – probably from too much studying – and normally don’t have space in their little white vans for dust sheets. The thing here is not to mention anything and supply and fit your own dust sheets if you value your furniture and furnishings.

Did I mention the asthma?  I don’t like mentioning this but rumor has it that almost all electricians are asthmatic. I’m not entirely sure about this so I am going to use the word “allegedly” but it first came to my attention when I noticed that on every job I went on where electricians had been working there was grit and dust everywhere. I soon discovered that electricians never clean up during the job or after the job.

Now don’t jump to the wrong conclusion here, it’s not because they don’t want to clean up, it’s just that they can’t because the dust would be really bad for their chest and presumably would give them an asthma attack.

It’s also accepted in the building & construction industry that electricians tend to speak their own languarge when you gat a few of them together.  I think it called isolatercrap which I believe is used widley especially when dealing with customers and invoicing.

The point is that you shouldn’t be afraid to ask if you don’t understand what is being said and if they use a bit of their own language – by mistake – then ask for  an explaination in english so that you know what the actual job is and what it is you’re going to have to pay heavily for.

RALEIGH, NC – Wake Technical Community College has awarded Hardin Construction Company to build an innovative, six-level parking facility to be completed in 300 days at the college’s Health Sciences Campus.

The $6.9 million Health Sciences 2 Parking Deck is designed to a 100-year standard and will feature some complex systems for achieving this objective.

The project will encompass a number of sustainability features, for which the college hopes to earn points toward LEED certification for a future academic building, to which the parking deck will be connected.

LEED-or Leadership in Energy and Environmental Design- is a third-party certification program of the U.S. Green Building Council and the nationally accepted benchmark for the design, construction and operation of high-performance green buildings.

The Building & Construction Trade Has Changed for Ever

There was a time when you worked on larger building sites that it was almost exclusively British or at best with a liberal sprinkling or Irish. Nowadays however, if you visit any large building site you are likely to hear a wide selection of languages been spoken as there has been a huge influx in foreign workers entering the UK Building & Construction Trade.

Whilst there is no doubt the industry has changed the question I’m asking is if the changes are for the better or the worse. All changes have a negative and positive effect regardless. For example you can now get a building laborer in London for an average pay of £40.00 per day whilst the costs back in 1980 – some 30 years ago – was around £50.00. One thing is for certain and that is there are plenty of businesses out there that are more than happy to exploit the foreign workers to make some extra cash.

Back in the 60/70’s you could find 200 Irish men in Kilburn High Street at 5am on a Monday morning as at that time they were the foreign workers of the day and of course were grossly exploited. In the years that followed the Irish worked diligently and gradually shook of their exploitative masters and no doubt some of them took on the role of exploiter for the next generation of Irish workers just arrived.

So here we are 40/50 years later and nothing much seem to have changed other than nationality of the exploited. In recent years it was the Poles who came here in their thousands to face the problems of language and exploitation. The British consumer soon got on the bandwagon and became quickly aware that there were savings to be had by using Polish building workers. With new players in the marketplace that had virtually no overheads, and had little or no intention to pay taxes the prices for building & construction services stabilized.

In areas such as London where Polish workers were operating the competition was felt and not only stabilized prices but in fact brought prices down dramatically. Where as before, builders were able to put in reasonable and even inflated prices now they were lucky to actually get any work. Layoffs were considerable as jobs dried up in favor of the cheaper Polish tradesmen which were followed by even more eastern European workers who were undercutting the Polish. Ask the average small builder about how their business is ticking over and they will tell you that times are tough. Recession is one things but the foreign workers have killed the industry almost entirely. Its quite common now that when you visit a client to inspect a job with the intention of providing an estimate you are competing against whole families of builders that have little or no overheads, no insurance and no intention of paying tax so they can under cut the job by half and still do well from it.

Are The Homeowners Getting A Good Deal?

Clearly not, as the standard of some of the foreign workers is way below the UK standards. Whilst they may be trying to do good work unfortunately the majority have no idea about building regulations, safety issues and have no experience whatsoever in the services they provide.

Another huge issue is the communication. it’s not uncommon that you might have five or six builders working in a team and only one speaks English. The odds of coming back and finding the wrong wall has been removed or the cat hatch is in the wrong door is high.

Most homeowners need a little direction on their projects so just imagine if you will having a team of foreign workers building your extension or renovating your home when they haven’t got a clue about the structure of the building, popular trends or the actual safety & building regulations. It’s a recipe for disaster and it happens all the time. One of the recent cases I head on the news was about the client that wasn’t happy about the work done my a group of Polish builders. When the client refused to pay the builders moved into the clients home and squatted.

I don’t know how that one was resolved but it fair to say that that’s one client that won’t be using foreign workers in the future.

There are several factors to consider when engaging the services of builders. If you just consider the actual costs of the project as the basis for hiring a builder then you are likely to run into trouble.

Good communication skills are a must for any project as you need to be able to express your requirements clearly & concisely.
